These terms apply between you and Volt Time B.V., trading as Plugchoice (KvK 77488873, De Entree 99, 1101 HE Amsterdam, the Netherlands, support@plugchoice.com), when you use the Plugchoice platform, app or portal as a private individual (consumer).
1. What these terms are
1.1. The Plugchoice General Terms apply to everyone who uses the platform. These End User Terms come on top for consumers. If the two conflict, these End User Terms win for you.
1.2. Nothing in these terms limits the rights you have under mandatory consumer law.
1.3. If you use Plugchoice through the branded portal or app of an installer or operator (a "partner"), you are still contracting with us, Volt Time B.V. trading as Plugchoice, and we remain responsible for the platform and your data as described in our Privacy Policy. The partner is responsible for its own services to you.
2. Your account
2.1. You must be at least 16 years old to create an account. If you are younger, a parent or guardian must create and manage the account.
2.2. Keep your login details private and tell us via support@plugchoice.com if you think someone else has access.
2.3. Information in your account must be accurate. Other people you invite to your location can see certain data about the location and its chargers; invite only people you trust.
2.4. Charge cards and tags linked to your account: sessions started with them count as yours until you report the card lost or block it in the platform. Block first, ask questions after.
3. The free platform
3.1. The core platform is free. We aim to keep a free core platform, but we decide which features are part of it, and features can change, improve or disappear over time (see clause 9).
3.2. The free platform comes without guaranteed availability and without guaranteed support. We normally answer via chat and email at support@plugchoice.com, but we cannot promise response times on the free platform.
4. Paid modules
4.1. You can buy optional modules per charger, such as Smart Charging. What a module does, and its price including VAT, is shown before you buy.
4.2. A module works only on the charger you activated it for. A "lifetime" license is tied to that specific charger and to your account. If the charger breaks and is replaced by the same model, we will transfer the license once. Licenses do not automatically move to a new owner if you sell or give away the charger.
4.3. Subscriptions with a fixed first period renew after that period for an indefinite time, and you can then cancel at any time with one month's notice. You can also always cancel at the end of the first period.
4.4. Right of withdrawal: for online purchases you have 14 days to change your mind. If you ask us to start the module immediately, you pay proportionally for the days used; for a completed one-off service or fully delivered digital content that you agreed to receive immediately, the withdrawal right lapses to the extent the law allows. We point this out at purchase.
5. Smart charging and power management: what you need to know
5.1. These functions steer real electrical equipment in your home or building based on the limits and information you (or your installer) enter, and on what your charger and meter report to us. We cannot see your actual installation.
5.2. You must make sure that: the installation and fuses are suitable, the values entered in the platform are correct, and installation was done by a professional.
5.3. We are not liable for damage caused by wrong or incomplete information or limits, faulty installation or configuration, hardware that misbehaves, or conflicts with equipment we do not manage (such as a home battery from another brand). Your legal rights for defects in our own service remain intact.
5.4. Savings shown in the app are estimates. They will not always match your energy bill.
5.4a. Some vehicles limit or advise against frequent start/stop charging cycles or scheduled charging. Check your vehicle's manual; choosing modes that suit your vehicle is your responsibility.
5.5. If a charger loses connection, it falls back to the safe default current configured for it. Make sure that default suits your installation.
6. Charging data, your meter and platform information
6.1. Session and energy data come from your charger's own meter. We show and process this data as we receive it; we cannot guarantee the meter is right. If numbers look wrong, contact support@plugchoice.com.
6.2. Other information in the platform comes from three places: your charger, what you or your installer entered, and our own records about charger models (for example which features a model supports or whether its meter is marked as MID-certified). All of it can contain mistakes. If money depends on it, for example reimbursement or ERE certificates that require a MID meter, check your charger's own documentation and markings first. We are not liable for losses from relying on this information, except where the law does not allow us to exclude that.
7. Connecting other services (operators, ERE, integrations)
7.1. You can connect your charger to services of other companies, for example a charging operator or an ERE booking service, through the platform. You choose the service; you authorize the connection; you can disconnect at any time in the platform.
7.2. Once connected, that company receives your data for its own service and is itself responsible for what it does with it. Their terms and privacy policy apply to their service.
7.3. ERE: the booking service you pick handles registration, verification and payouts. Amounts shown in the platform are estimates, not guaranteed income.
8. Firmware
8.1. Charger firmware is made by the charger's manufacturer, not by us. We only pass it on and help install it. Installing firmware, manually or automatically, is at your own risk with respect to that firmware; we are of course still responsible for our own platform working with care.
9. Changes
9.1. We keep developing the platform, so features change. If we discontinue a paid module you use, or the whole platform, we will tell you at least 3 months in advance and refund the part of any periodic fee you prepaid for the time after the stop date. A one-off lifetime license is tied to the life of the module itself: if the module is discontinued, the license ends with it, without refund.
9.2. If we change these terms or raise a price in a way that disadvantages you, we will tell you at least 30 days in advance by email or in the app, and you may cancel before the change takes effect without cost. Price changes never apply retroactively to a period you already paid.
10. If something goes wrong
10.1. If a paid module does not work as promised, tell us. We will fix it, and if we cannot fix it within a reasonable time you get the money back for the affected charger and period. Your legal remedies for a defective service remain available.
10.2. We are not liable for indirect damage such as lost income (including missed ERE or flexibility revenue) or costs of not being able to charge, and our liability toward you is in any case limited to EUR 2,500 per event, except where the law does not allow us to limit it (for example damage caused intentionally, or death or personal injury caused by our fault).
10.3. Failures of third parties we depend on (hosting, connectivity, payment provider, operators you connected) are beyond our control; we will do our best to restore service but are not liable for their outages.
11. Ending
11.1. You can stop using the platform and delete your account at any time. Paid periods already started are not refunded unless clause 9 or 10 applies or the law says otherwise. If you sell or hand over your charger, or move house, remove the charger from your account or transfer it to the new owner; until then, sessions and settings remain attributed to your account.
11.2. Important: deleting your account or the app does not by itself disconnect your charger. The charger keeps its connection and keeps sending technical data until it is disconnected or re-pointed. Remove the charger from the platform before deleting your account, or ask support@plugchoice.com to do it.
11.3. We can suspend or end your access if you seriously misuse the platform, break these terms, or endanger security, and we will explain why unless the law prevents us.
12. Practical
12.1. Our privacy and cookie policies explain how we handle your data; they are available on plugchoice.com.
12.2. All contact runs through support@plugchoice.com.
12.3. Dutch law applies. You can always bring a dispute before the court that the law designates for you as a consumer. You can also use the EU online dispute resolution platform (ec.europa.eu/odr).
12.4. These terms are in English for now; a Dutch version may follow. If we publish both, you may rely on the version in your language.
Annex: Flexibility and VPP
This annex is dormant and activates only when we launch these features.
V.1. If we introduce features that use your charger's flexibility (for example pausing or shifting charging to support the grid or energy markets), each such feature is separate and off by default. It only applies to you if you switch it on.
V.2. For each feature you switch on, we will tell you first: what is steered, what data is used, what you can earn or save, and how to switch it off. You can switch off at any time, and you can always override a session (boost) to charge at full available power.
V.3. Any earnings are calculated as described in the feature, are estimates until settled, and are paid out per the feature's payout rules (including a minimum payout threshold). Unclaimed earnings lapse 12 months after your account is closed.
V.4. Switching a flexibility feature on means you allow us and our named partners to steer the charging of your vehicle within the boundaries you set. We never intentionally leave you below the charge level you asked for by your departure time; if inputs are wrong or the vehicle or charger misreports, the result can differ.
V.5. Vehicle connections have side effects we cannot fully control: keeping a vehicle reachable for steering can wake its systems and consume its auxiliary (12V) battery. We are not liable for vehicle-side effects of the vehicle remaining awake or reachable.
